1. General

1.1. Butchery Wisse (hereinafter Butchery Wisse) sells meat (products) and related delicacies.

1.2. In these terms and conditions, the following terms are used: Slagerij Wisse, located at Torenstraat 4 in Meliskerke, registered with the Chamber of Commerce under trade register number 22008769, VAT number NL009607973B01.

– Buyer: the natural person, partnership, company or legal entity that has commissioned Slagerij Wisse to deliver a product.

– Website: the website maintained by Slagerij Wisse https://slagerij-wisse.nl/

1.3. Slagerij Wisse reserves the right to supplement or amend these General Terms and Conditions at any time.

1.4 The text of these Terms and Conditions will be made available to the Buyer on the website. By placing an order, you agree to these Terms and Conditions.

2. Offer and Agreement

2.1 If an offer has a limited period of validity or is made subject to conditions, this will be explicitly stated in the offer.

2.2 Information, images, verbal statements, specifications, etc., regarding all offers and the main characteristics of the products provided by Slagerij Wisse in any way, are presented and/or provided as accurately as possible. However, Slagerij Wisse cannot guarantee that all offers and products fully correspond to the information provided. Deviations cannot constitute grounds for and/or cause for compensation and/or termination.

2.3 Allergens: We work with various allergens in our butcher shop. Do you have a food allergy or a question about the composition of our products? We're happy to answer them.

2.4 Each offer contains sufficient information to clearly indicate to the Buyer the rights and obligations associated with accepting the offer. This includes:

– the price including VAT;

– the payment method;

– any delivery costs and method.

The agreement can be archived after its conclusion, as it is sent via the order form to the email address provided by the Buyer. The Buyer is responsible for providing a valid and working email address.

2.5 An offer to the potential Buyer is deemed to have been made in one of the following circumstances:

The potential buyer has fully entered the requested information on the website's dedicated form and sent this information electronically to Slagerij Wisse. Slagerij Wisse has received this information.

– or Slagerij Wisse has issued a personalized quotation to the potential Buyer, which has been agreed to verbally and/or in writing by the potential Buyer.

2.6 An agreement is concluded once an order confirmation has been handed over to the Buyer or, if the offer was made through the webshop, sent by email to the correct email address provided by the Buyer. This agreement may be canceled by Slagerij Wisse if the Buyer does not meet the conditions set by Slagerij Wisse or if it becomes apparent at any time that the Buyer has not met the conditions in the past.

3. Prices

3.1. All prices are stated in euros, in accordance with applicable legal regulations, and include VAT. The Buyer owes the price that Slagerij Wisse has communicated to the Buyer in its confirmation in accordance with Article 2.3 of these terms and conditions. The purchase price is due in advance; until Slagerij Wisse has received this amount, Slagerij Wisse will not deliver any products. In exceptional cases, products remain the property of Slagerij Wisse at all times until the full amount due has been received.

3.2. Obvious (manipulation) errors in the price quote, such as obvious inaccuracies, can be corrected by Slagerij Wisse even after the agreement has been concluded. Special offers are only valid while supplies last.

3.3. During the validity period stated in the offer, the prices of the products and/or services offered will not be increased, except for price changes due to changes in VAT rates and/or market fluctuations.

3.4. Notwithstanding the previous paragraph, Slagerij Wisse may offer products or services with variable prices, the prices of which are subject to market fluctuations over which the entrepreneur has no control. This subjection to fluctuations and the fact that any stated prices are target prices will be stated in the offer.

4. Payment

4.1. The Buyer is obligated to immediately report any inaccuracies in the payment information provided or stated to Slagerij Wisse.

4.2 In the event of non-payment or non-payment (in full) by the Buyer, Slagerij Wisse has the right, subject to legal restrictions, to charge the reasonable costs made known to the consumer in advance.

5. Delivery, execution and shipment

5.1 Orders will be delivered by or on behalf of Slagerij Wisse after payment has been received by the Buyer on the delivery date specified by the Buyer. The delivery time indicated by Slagerij Wisse is only an estimate and cannot be legally binding.

5.2 Deliveries will be made to the address provided by the Buyer when concluding the agreement. The Buyer is responsible for providing the correct address and for receiving the products promptly.

5.3 The Buyer is obliged to take delivery of the purchased goods within the agreed period and/or around the agreed time.

5.4 If, at the intended delivery time by the postman/courier, neither the Buyer nor a person designated by them is present at the delivery address, or if the Buyer or the aforementioned designated person cannot or does not wish to accept the package, Slagerij Wisse will no longer guarantee the correct temperature of the products in the packaging from that moment on. In such a case, the delivery person will, if possible, leave the package with your neighbors or across the street and leave a note in your mailbox.

5.5 Immediately upon receipt, the Buyer must inspect the products and immediately place the relevant products in the refrigerator. If the Buyer unexpectedly receives products in poor condition or that do not meet the quality requirements for the products, we request that the Buyer inform us immediately, no later than within 3 hours of receipt. For this purpose, the Buyer can contact our butcher shop by phone at 0118-566066 or by email outside regular opening hours at info[at]slagerij-wisse[dot]nl or info@slagerij-wisse.nl.

Butcher shop Wisse will do everything possible to resolve any problem as quickly and efficiently as possible.

5.6 If delivery of an ordered product proves impossible, Slagerij Wisse will endeavor to provide a replacement item. The fact that a replacement item is being delivered will be clearly and comprehensibly communicated at the time of delivery. Slagerij Wisse will endeavor to inform the Buyer of this prior to delivery.

6. Force Majeure

6.1 In the event of force majeure, Slagerij Wisse is not obligated to fulfill its obligations to the Buyer. Slagerij Wisse is entitled to postpone its obligations for the duration of the force majeure.

6.2 Force majeure means any circumstance beyond its control that prevents it from fulfilling its obligations to the Buyer. These circumstances include, but are not limited to, disruptions in a (telecommunications) network, connection, or communication system used, power outages, the unavailability (or lack thereof) of the Website, non-delivery or late delivery by suppliers, strikes, fire, business disruptions, or other third-party involvement.

7. Personal data

Slagerij Wisse will process the Buyer's data solely in accordance with its privacy policy. All data provided by (potential) Buyers for deliveries will be handled with care and stored securely. This data will only be used internally by Slagerij Wisse and will not be shared with third parties. Slagerij Wisse complies with all applicable laws and regulations.

8. Liability and indemnity

8.1. Slagerij Wisse is never liable for any indirect damage suffered by the Buyer or third parties, including consequential damage, business damage, delay damage, loss of profits or personal injury, or any (other) indirect damage, from whatever cause and suffered by whomever.

8.2. The Buyer shall indemnify Slagerij Wisse against all third-party claims, on any grounds whatsoever, regarding compensation for damage, costs, and/or interest caused by, occurring during, or in any way related to the products supplied by us.

9. Other provisions

9.1. All judicial and extrajudicial costs of any nature incurred by Slagerij Wisse as a result of the Buyer's failure to meet their payment obligations shall be borne by the Buyer. In the event of late or full payment, Slagerij Wisse is entitled to terminate the agreement with immediate effect or suspend (further) delivery until the Buyer has fully met their payment obligations; this includes the payment of judicial and extrajudicial costs of any nature.

9.2 The agreements entered into by Slagerij Wisse are governed by Dutch law. In the event of a dispute, the competent court in the Netherlands has jurisdiction.
